At Everaert Advocaten, we regularly receive messages from clients who, after using tools like ChatGPT, believe they qualify for a residence permit or Dutch citizenship. However, in many cases, the conditions described are incorrect, or the mentioned permits do not exist at all.

While AI technologies like ChatGPT can provide general information, they cannot fully grasp the complexity and nuances of immigration and nationality law. The legislation surrounding residence permits and Dutch citizenship is often detailed and depends on specific circumstances, which AI may misinterpret or overlook.

To obtain Dutch citizenship through naturalization, several conditions must be met, including the integration requirement. Although one does not have to pass the integration exams to obtain a (permanent) residence permit at retirement age, the integration requirement applies in full to naturalization. Exceptions may possibly apply to the person in question, for example because one has received Dutch education, but there is no automatic exception for pensioners. However, there is no integration requirement to obtain Dutch citizenship through the option procedure. This includes someone who reached the age of 65 and has resided in the Kingdom of the Netherlands for at least 15 years.
